Este artículo presenta el análisis de los rasgos definitorios de los álbumes con tal temática mediante el estudio de un corpus de cuatro ejemplos, y ahonda en las (...) posibilidades didácticas de un título en particular, Bruno. El niño que aprendió a volar, de Nadia Terranova y Ofra Amit. Los resultados nos hacen concluir que es posible crear desde el lirismo imágenes para enseñar la más infame atrocidad. (shrink)

L'obiettivo di questo lavoro è analizzare la percezione che gli insegnanti di scuola secondaria di secondo grado dell’area metropolitana di Bologna (Italia) hanno della storia e del suo insegnamento. Attraverso una ricerca quantitativa svolta attraverso la somministrazione di un questionario su scala Likert a novantanove insegnanti dell’area metropolitana di Bologna si sono potuti identificare risultati ambivalenti. Da una parte, gli insegnanti possiedono generalmente una ottima e spesso consapevole, ma migliorabile, concezione epistemologica nei confronti della storia e del suo insegnamento; tuttavia, (...) emerge una concezione non olistica del patrimonio, degli strumenti e delle metodologie didattiche a disposizione nella pratica docente; infatti gli insegnanti affermano di utilizzare in classe prevalentemente la spiegazione frontale, lasciando alle attività laboratoriali legate alle fonti un ruolo marginale. Ante las insistentes críticas del mecanicismo continental que caracterizaban la fuerza gravitacional como una “cualidad oculta” Newton redactó en el “Escolio general” una breve respuesta en la que se afirmaba que la fuerza era real y era suficiente la explicación que había dado de ella en los Principia para sostenerla como tal. Al respecto dos interpretaciones han pretendido explicar cuáles son los aspectos metodológicos y matemáticos de esta respuesta de Newton. En el artículo se muestra que la lectura más reciente (...) permite comprender algunas de las limitaciones de la interpretación clásica, al acentuar el carácter metodológico de la demostración, resaltando la relación entre matemáticas y filosofía natural planteada en el “Prefacio al lector” de la primera edición de los Principia de Newton. The discovery of Neptune was one of the greatest achievements of nineteenth-century astronomy. Using nothing but calculus and some observations of the Uranus’ anomalous motion, Adams and Le Verrier got to determine, independently, the possible place and mass of a hypothetical planet, which would produce its observational discovery. In this paper I will demonstrate that the methods used by these astronomers were influenced by Newton’s method of analysis and synthesis. Considering this, I will also expose, that some astronomy’s general epistemological (...) principles could be deduced when we consider these investigation methods. (shrink)

The main claim of this paper is the following: In a typical rational legal system, legal adjudication is necessarily discretional. Discretion is the result of what I call ‘systemic indeterminacy’. Systemic indeterminacy is the thesis that claims that typical rational legal systems that have an interpretative code with more than one interpretative directive and the non-redundancy clause are necessarily indeterminate. Since typical rational legal systems do not have redundant rules a plurality of interpretative directives will necessarily yield a plurality of (...) interpretative results. Due to the non-liquet rule judges are obligated to choose among the different interpretative results provided by the interpretative code. In other words, by building a thesis on legal indeterminacy as the consequence of having a plurality of interpretative directives that necessarily yield different results, I proceed to provide an account of discretion as a necessary feature of legal adjudication. This paper characterizes José Celestino Mutis’ (1732–1808) appropriation of Newton in the Viceroyalty of New Granada. First, we examine critically traditional accounts of Mutis’ works highlighting, on the one hand, their inadequacy for directing their claims toward the nineteenth-century independence from Spain and, on the other, for not differentiating between Newtonianism and Enlightenment. Next, we portray Mutis’ complex Newtonianism from his own statements and from printed sources, including a variety of works and translations from British, Dutch, and French authors, in (...) addition to a wide range of Newton’s writings, unusual for an eighteenth-century reader in the Americas. Finally, we analyze a salient claim of Mutis’ Newtonianism in order to depict his appropriation and transformation of Newton’s ideas: the characterization of Newtonian experimental physics as a useful science. In so doing, Mutis further developed metaphysical and methodological positions not present in Newton’s works. (shrink)

In discussions of standards of proof, a familiar perspective often emerges. According to what we call specificationism, standards of proof are legal rules that specify the quantum of evidence required to determine that a litigant’s claim has been proven. In so doing, they allocate the risk of error among litigants (and potential litigants), minimizing the risk of certain types of error. Specificationism is meant as a description of the way the rules actually function. We argue, however, that its claims are (...) either mistaken or at a minimum deeply misleading, especially when it comes to standard of proof rules (SPRs) that contain indeterminate formulas, as is typical. As against specificationism, we argue that SPRs are best understood as rules that confer competence to decide whether a given standard has been met—according to whatever vague or inchoate interpretation (if any) of the rule in question triers of fact implicitly or explicitly employ. ABSTRACT This article interprets a recently recovered manuscript, Tratado de astronomía y la reformaçión del tiempo, composed by Antonio Sánchez in New Granada c.1696, in the context of the Spanish and Renaissance cosmographies. Sánchez’s Tratado proposes a spherical astronomy, in which celestial bodies – including comets — move in orbs containing pyramidal knots that explain the changing speed observed in the motion of planets. From this astronomy and following the peninsular style of repertorios, Sánchez derives two major conclusions: the corrected (...) length of the solar year and a revised birth date of Jesus. Taking as center of reference Vélez, where Sánchez was based, these claims led to conclusions in domains ranging from calendric astronomy to eschatology, including the incorporation of the indigenous peoples into salvation narrative and a demonstration of the arrangement of the celestial orbs at the Last Judgment. Sánchez’s Tratado constitutes an expansion of the Spanish mathematical cosmography that sheds light on the production of knowledge in the Spanish-American world and, at the same time, provides elements to reassess our understanding of the global circulation of Renaissance and early modern ideas. The Uniform Determination of Death Act (UDDA) provides that “an individual who has sustained either (1) irreversible cessation of circulatory and respiratory functions or (2) irreversible cessation of all functions of the entire brain, including the brain stem, is dead.” We show that the UDDA contains two conflicting interpretations of the phrase “cessation of functions.” By one interpretation, what matters for the determination of death is the cessation of spontaneous functions only, regardless of their generation by artificial means. By the (...) other, what matters is the cessation of both spontaneous and artificially supported functions. Because each UDDA criterion uses a different interpretation, the law is conceptually inconsistent. A single consistent interpretation would lead to the conclusion that conscious individuals whose respiratory and circulatory functions are artificially supported are actually dead, or that individuals whose brain is entirely and irreversibly destroyed may be alive. We explore solutions to mitigate the inconsistency. (shrink)

The essay represents teaching as the coming to be of the human individual. In order to do so, it reflects on the character of human life by which it is knowledge of itself. Being knowledge of itself, human life is self-determining or free. Therefore generality and particularity come together in the human being in a distinctive way: a human being is not an exemplar, instance or specimen of a species, nature or life-form. Rather, she is her own principle. This is (...) captured in the idea of the human being as an individual. The essay reveals teaching to be the form of coming to be which is proper to what is an individual in this sense. In this way, the essay shows teaching to be internal to human freedom. (shrink)

What does the truth of a judgment consist of, according to F. H. Bradley? What is its ultimate nature? In particular, how does such a property relate to reality? At least three interpretive theses have been offered: (i) that Bradley defended a theory of truth as coherence; (ii) that, rather, Bradley defended a robust variant of the identity theory of truth; and (iii) that, in any case, Bradley rejected the correspondence theory of truth. In this article I question these three (...) theses and argue that the position defended by Bradley is perfectly compatible with a weak variant of the correspondence theory of truth. This, by the way, makes his position vulnerable to certain objections. Bradley’s merit consists not so much in having answered them satisfactorily as in having anticipated them and assumed them as eventual consequences of his position. (shrink)

Research on value congruence rests on the assumption that values denote desirable behaviors and ideals that employees and organizations strive to approach. In the present study, we develop and test the argument that a more complete understanding of value congruence can be achieved by considering a second type of congruence based on employees’ and organizations’ counter-ideal values. We examined this proposition in a time-lagged study of 672 employees from various occupational and organizational backgrounds. We used difference scores as well as (...) polynomial regression and response surface analyses to test our hypotheses. Consistent with our hypotheses, results reveal that counter-ideal value congruence has unique relations to employees’ trust in the organization that go beyond the effects of ideal value congruence. We discuss theoretical and practical implications of this expanded perspective on value congruence. (shrink)

Goal: To assess public knowledge and attitudes towards the family’s role in deceased organ donation in Europe. -/- Methods: A systematic search was conducted in CINHAL, MEDLINE, PAIS Index, Scopus, PsycINFO, and Web of Science on December 15th, 2017. Eligibility criteria were socio-empirical studies conducted in Europe from 2008 to 2017 addressing either knowledge or attitudes by the public towards the consent system, including the involvement of the family in the decision-making process, for post-mortem organ retrieval. Screening and data collection (...) were performed by two or more independent reviewers for each record. -/- Results: Of the 1482 results, 467 studies were assessed in full-text form, and 33 were included in this synthesis. When the deceased has not expressed any preference, a majority of the public support the family's role as a surrogate decision-maker. When the deceased expressly consented, the respondents' answers depend on whether they see themselves as potential donors or as a deceased's next-of-kin. Answers also depend on the relationship between the deceased and the decision-maker(s) within the family, and on their ethnic or cultural background. -/- Conclusions: Public views on the authority of the family in organ donation decision-making require further research. A common conceptual framework and validated well-designed questionnaires are needed for future studies. The findings should be considered in the development of Government policy and guidance regarding the role of families in deceased organ donation. (shrink)

Introduction: This paper has two, interrelated aims. The first is to clarify Sartre's theory of intersubjectivity. Sartre's discussion of the Other has a puzzling way of going in and out of focus, seeming at one moment to provide a remarkably original solution to the problem of other minds and at the next to wholly miss the point of the skeptical challenge. The nature of his argument is equally uncertain: at some points it looks like an attempt to mount a transcendental (...) argument, a kind of Refutation of Idealism regarding the existence of others, at others, to be a defence of direct realism; yet again, it can seem to propose a dissolution of the problem closely analogous to Wittgenstein. I will argue (Section 1) that none of these provides quite the right model for understanding Sartre, which requires one to take seriously his method of resolving epistemological issues into matters of ontology. I argue further (Section 2) that Sartre's theory becomes fully coherent only if we make explicit its implicit presupposition of a conception of intersubjectivity articulated by Fichte. My second aim is to pursue the connection opened up of Sartre with German idealism. To the extent that commentators attempt to relate Sartre systematically to German idealism, it is almost always Hegel who provides the other term of comparison.1 What I try to show (Section 3) is that the usual comparison of Sartre with Hegel, which is largely negative, is distracting, and that Sartre's closer philosophical [End Page 325] relations are to Fichte and Schelling.2 This supplies, I argue, an important correction to the tendency of anglophone discussion of Sartre to isolate his claims from historical considerations, or to restrict Sartre's historical frame of reference to Hegel, Husserl and Heidegger: Sartre's philosophy, I suggest, is viewed fruitfully in the context of philosophical debates pursued in early German idealism. Sartre's ethics, I argue (Section 4), provide supporting evidence for this view. I propose tentatively in conclusion (Section 5) a corresponding view of existential phenomenology as a whole. In this article I attempt to give an account of the thesis according to which composition is identity and of the criticisms that might be formulated against it. According to a weak version of the thesis, composition, in virtue of being analogous in important respects to identity, is as ontologically innocent as identity. According to the strong version of the thesis, composition is literally a species of the generic relation of identity, and is as ontologically innocent as any species of (...) identity. As we will see, the weak version begs the question or incurs in a non sequitur ; and the strong version is incoherent and faces a dilemma. Thus, composition is not identity: one thing cannot be identical to many things. (shrink)

In this review, we present a rigorous construction of an algebraic method for quantum unstable states, also called Gamow states. A traditional picture associates these states to vectors states called Gamow vectors. However, this has some difficulties. In particular, there is no consistent definition of mean values of observables on Gamow vectors. In this work, we present Gamow states as functionals on algebras in a consistent way. We show that Gamow states are not pure states, in spite of their representation (...) as Gamow vectors. We propose a possible way out to the construction of averages of observables on Gamow states. The formalism is intended to be presented with sufficient mathematical rigor. (shrink)

Como devemos conduzir nossas investigações morais para decidir no que acreditar sobre questões morais? Como a plausibilidade de juízos, teorias e princípios morais deve ser avaliada? Como devemos tentar remover nossas dúvidas quando estamos incertos sobre o que é certo ou errado, bom ou mau, justo ou injusto? O método do equilíbrio reflexivo, desenvolvido por John Rawls em A Theory of Justice e desde então adotado por um crescente número de filósofos, é uma tentativa de responder a questões como essas. (...) O equilíbrio reflexivo pode ser interpretado de vários modos, muitos dos quais completamente incompatíveis entre si, mas as duas visões mais representativas do método são os modelos coerentista e intuicionista. Neste artigo o meu objetivo é argumentar que nós deveríamos entender o equilíbrio reflexivo como um método intuicionista de investigação moral. Assim, eu comparo essas duas visões, como elas diferem no modo como concebem o funcionamento e os objetivos do método, para defender que a tradição coerentista de interpretação do método reduz a investigação moral a uma mera busca por coerência, com isso ignorando a função metodológica que intuições morais desempenham em nossas reflexões morais. Em contraste, a interpretação intuicionista oferece um modelo de investigação que integra intuição morais com a busca por coerência, explicando por que e como esses dois elementos funcionam em conjunto em nossas reflexões morais. A minha alegação é a de que apenas quando o equilíbrio reflexivo é interpretado de acordo com esse modelo intuicionista que ele pode ser visto em uso na prática reflexiva de filósofos morais reconhecidamente competentes, como John Rawls, Judith Jarvis Thomson e Peter Singer. De modo sintético el sujeto se funda en la nada el recorrido de la esencia, que se redefinirá como invenir para alcanzar el mayor grado de objetividad en el acto, en la actividad de lo real. Al fin, inmerso en una realidad dinámica se postula la vida, ya no como sujeto, para ahondar en la experiencia como un tránsito en el (...) que el conocimiento es posible dentro de lo indeterminado. El aprendizaje de la Historia en Educación Secundaria se relaciona con un proceso memorístico y conceptual que dificulta la formación del pensamiento crítico y reflexivo en el alumnado de esta etapa educativa. Por este motivo, con esta experiencia y desde un enfoque investigativo, hemos fomentado la curiosidad y el interés de los alumnos de 1º de Secundaria por las prácticas religiosas y funerarias que profesaron los romanos. El método de enseñanza-aprendizaje fue activo y participativo, lo que facilitó la indagación y (...) la experimentación del taller “Funus romanorum”. Los resultados mostraron las ventajas de trabajar la arqueología experimental para comprender mejor los hechos acaecidos en la Antigüedad y adquirir contenidos históricos a través de talleres experienciales. Cruelty is evident in the play and interactions of quite small children. This is almost certainly normal, though it is more evident in children who have themselves been harshly treated (Amato & Fowler 2002; Luk et al. 1999).

¿Estuvo la cultura de autoría impresa fuera del alcance de las mujeres antes de 1887 en Costa Rica? El propósito principal de este artículo es ofrecer una primera respuesta a dicha pregunta con base en una revisión preliminar de periódicos y revistas quepermiten considerar el problema planteado desde una perspectiva más amplia. En breve, el argumento central que se va a desarrollar es que la construcción de esa autoría pasó por tres etapas: en la primera, durante las décadas de 1840 (...) y 1850, tal proceso se basó en la redacción de anuncios comerciales; en la segunda, centradaen los decenios de 1860 y 1870, predominaron los discursos de alumnas y maestras relacionados con actividades de enseñanza; y en la tercera, ubicada a partir de 1885, se dieron dos tendencias paralelas. Por un lado, algunas docentes comenzaron a dar a conocer sus producciones literarias; y por el otro, el Estado, en vísperas de la reforma educativa de 1886, implementó una política para que las educadoras elaboraran informes de sus actividades escolares y los enviaran a una revista especializada para ser publicados. The three ancient philosophical introductions translated in this volume flesh out our picture of what it would have been like to sit in a first-year Philosophy course in ancient Alexandria. Ammonius (AD 445-517/26) set up a new teaching programme in Alexandria with up to six introductions to the philosophy curriculum, which made it far more accessible, and encouraged its spread from Greek to other cultures. This volume's three introductory texts include one by his student Olympiodorus and one each by Olympiodorus' (...) students Elias and David. Elias' Introductions to Philosophy starts with six definitions of Philosophy, to which David adds replies to the sceptical question whether there is such a thing as Philosophy. Olympiodorus' text translated here is an Introduction to Logic, which is just one of the three introductions he wrote himself. (shrink)

Die vorliegende Arbeit untersucht Herkunft und Inhalt des Musikbearbeitungsrechts und ordnet dieses dogmatisch den urheberrechtlichen Regeln zu. Weiter wird die Frage der Wahrnehmungsgrenzen der GEMA bezüglich des Bearbeitungsrechts thematisiert, und die Folgen für konkrete Nutzungshandlungen werden herausgearbeitet. Die Probleme der Klingeltonnutzung, der Coverversionseinspielungen, Werkteilnutzungen sowie der Nutzung von Musik im Bereich der Werbung, des Theaters und des Films werden im Hinblick auf das Bearbeitungsrecht und die Wahrnehmungskompetenz der GEMA analysiert. Der Autor führt mit der vorliegenden Arbeit die Grauzonen der GEMA-Wahrnehmung (...) aufgrund neuer dogmatischer Ansätze einer einheitlichen Lizenzierung zu, um die Problemfälle der Praxis zu beseitigen.
